New York pesticide annual report and use records

In New York, certified commercial pesticide applicators and technicians report every pesticide application of the year to the Department of Environmental Conservation (DEC) by February 1 of the next year, under the Pesticide Reporting Law (ECL §33-1205). Each application record gives the EPA registration number, product name, quantity used, date and the address including the 5-digit ZIP. Records also keep the dosage rate, method, target and the exact place of application, and are kept for 3 years. Reports are filed electronically.

What goes in the annual report

One line per application (ECL §33-1205(1)):

  • EPA registration number
  • Product name
  • Quantity of each pesticide used
  • Date applied
  • Location by address, including the 5-digit ZIP code

What the records add

The records behind the report also hold the dosage rate, method of application and target organism. DEC’s enforcement directive OGC 3 adds the "place": precise enough for someone to return and find the exact spot, such as "Apartment 5" at an address or "kitchen of restaurant". Records are kept for at least 3 years and shown to DEC on request.

January 15 or February 1?

The regulation (6 NYCRR 325.25) still says January 15. DEC’s directive OGC 3 lets one report under the statute satisfy both, and the statute’s February 1 date governs.

How to file

All annual reports are submitted electronically in a format DEC accepts. Since a 2022 change to the law, DEC no longer accepts paper reports. DEC offers a printable field notes template for keeping notes, but it is not an acceptable report and should not be mailed or uploaded.

Common questions

Does the address need the ZIP code?

Yes. The law asks for the location by address including the 5-digit ZIP. Make sure customer addresses are saved with it.

Can I mail DEC a printout of my records?

No. DEC says paper reports are no longer accepted. The data has to be typed or uploaded into one of DEC’s electronic spreadsheets or its software.
